Registration Terms & Conditions

These AWS DevDay Registration Terms and Conditions (these "Terms") contain the terms and conditions that govern your participation in the AWS DevDay SF hosted by AWS (the "Event"). These Terms are an agreement between Amazon Web Services, Inc. ("AWS," "we," "us," or "our") and you or the entity you represent ("you"). These Terms include any additional terms that may apply to specific aspects of the Event as well as the terms and conditions set out in any AWS Customer Agreement between you and AWS, or other agreement with us governing your use of our services (the “AWS Customer Agreement”). If these Terms are inconsistent with the terms and conditions contained or referenced in your AWS Customer Agreement, the terms and conditions contained or referenced in your AWS Customer Agreement will control. By registering for or participating in the Event, you confirm that you have read, understand and agree to these Terms. We may modify these Terms at any time by posting a revised version on the AWS website or by providing other notice to you. By participating in the Event, you agree to the latest version of these Terms. If you are an individual acting on your own behalf, you represent to us that you are lawfully able to enter into contracts, and if you are entering into these Terms for a company or entity, such as the company you work for, you represent to us that you have legal authority to bind that company or entity.

 

1. Registration.

To register for the Event, you must complete the Event registration process prior to any deadlines (if any) that are described on the registration page for the Event. Event registration may close earlier than posted deadlines, as determined in our sole discretion. Event registrations are subject to availability.

 

2. Fees.

There is no initial fee to participate in the Event. Participation in certain optional Event benefits may require fees, which will be posted on the AWS website. You agree to pay such fees if you participate in those Event benefits. All fees paid to AWS in connection with the Event will be non-refundable, including without limitation, if your participation in the Event is terminated for any reason by you or us. In addition, all use of AWS services beyond the scope or after expiration of any Event benefits, including without limitation all use exceeding the limits of any Event benefits, will be subject to the standard fees applicable to such AWS services. If registration fees or other fees are required for optional Event benefits, payment must be made via credit card prior to receiving such benefits.

 

3. Participant Cancellation and Refunds.

If registration fees or other fees are required for any Event benefits, cancellation instructions and the refund policy will be provided on the AWS website registration page for that Event.

 

4. Event Benefits.

If you participate in the Event, you may receive certain benefits from time-to-time as determined in AWS’s sole discretion and as described on the AWS website. You will be deemed to have accepted any additional terms and conditions, as applicable, before receiving these Event benefits. Such additional terms and conditions may include, for example and without limitation, the AWS Promotional Credit Terms & Conditions at aws.amazon.com/awscredits/, the AWS Free Usage Tier Offer Terms at aws.amazon.com/free/terms/, the AWS Support Guidelines at aws.amazon.com/premiumsupport/, and the AWS Training Agreement at aws.amazon.com/training/training-agreement/. All Event benefits you receive are personal to you (i.e., you individually if you are acting on your own behalf, or the company or entity you represent). You may not sell, license, rent, or otherwise transfer any Event benefits.

 

5. Event Changes and AWS Cancellation.

The Event program and benefits are subject to change. AWS may cancel the Event at any time and may deny, limit or cancel your participation or registration for the Event (including confirmed registrations) at any time, for any or no reason, with or without notice to you. We may update the AWS website or send you an email using the email address provided to us in your application for the Event to reflect any changes to the Event. Unless we state otherwise, any changes to the Event will become effective at the time we update the AWS Site with the change, or if we send you an email, as stated in the email message. AWS is not responsible for any damages, direct or indirect, resulting from any such change or cancellation. In the event of any cancellation by you or AWS, Sections 2–5 and 7–13 of these Terms will continue in full force and effect.

 

6. Code of Conduct.

AWS expects all Event participants (attendees, staff, speakers, sponsors, etc.) to behave in such a way as to create a safe, supportive learning environment while at the Event and any related events. AWS will not tolerate any form of harassment or offensive speech or behavior, including relating to race, gender, sexual orientation, religion or disability. Participants engaging in behavior deemed by AWS as discriminatory or offensive will be asked to leave the Event or related event immediately and will not be eligible to receive a refund of any fees paid to AWS related to the Event (if applicable). Anyone witnessing such behavior is encouraged to contact an AWS staff member so direct action can be taken. You agree to abide by this Code of Conduct at all times at the Event or related events.

 

7. Personal Information.

Please note that your contact details and other information we collect (including credit card information) are subject to the AWS Privacy Notice (http://aws.amazon.com/privacy/). You consent to our collection, use and disclosure of the information you enter when registering for the Event in accordance with the AWS Privacy Notice. Your contact information may be used from time to time to send details and announcements to you related to the Event and other related AWS communications, including information about events and training opportunities, invitations to participate in surveys and research opportunities and promotional offers. We may also provide your contact information to third-party Event sponsors if (a) you elect to attend any sessions or other activities at the Event hosted by AWS on behalf of Event sponsors (in which case we would provide your contact information to only the Event sponsor(s) acting as host), or (b) you opt-in during registration to receive communications from our third-party Event sponsors, or (c) attend partner hosted booth, exhibit, technical workshop, or consultation.

 

8. License to Use Items.

In consideration of the opportunity to participate in the Event, you grant to AWS and its affiliates, agents, employees and assigns an irrevocable, nonexclusive, royalty-free right and license throughout the world and in perpetuity to reproduce, edit, publish, distribute or translate, for advertising, publicity and promotional purposes or for any other purpose relating to AWS’s business, all or any part of the following items (“Items(s)”): (a) all still photographs and all audio and video recordings that AWS or its independent contractors make of you or your voice or likeness in connection with the Event, including the right to use your name, likeness and biographical information, and (b) all materials (electronic or hard copy) submitted or presented by you in connection with the Event. You consent to the use of the Items pursuant to the foregoing in perpetuity without compensation (unless prohibited by law) or additional consents from you.

 

9. Assumption of Risk.

You acknowledge and agree that your attendance and participation in the Event is voluntary. You agree to assume the risks associated with attending and participating in the Event to the fullest extent permitted under applicable law. If you choose to consume alcohol at any Event, you must be over the legal drinking age and you assume all associated risks.

 

10. Release of Claims.

You (for yourself, your heirs, personal representatives, assigns, and anyone else who might make a claim on your behalf) hereby release AWS and its affiliates, and their respective directors, officers, employees, contractors, representatives, agents, successors and assigns, from any and all claims, demands, causes of action, suits, damages, losses, debts, liabilities, costs and expenses (including without limitation reasonable attorneys’ fees and costs) that you may have now or in the future associated in any way with the Event or the Items.

 

11. Indemnification.

You will defend, indemnify and hold harmless AWS and its affiliates, and their respective directors, officers, employees, contractors, representatives, agents, successors and assigns, from and against any loss, damage, judgment, settlement, expense, interest, costs and expenses (including without limitation reasonable attorneys’ fees and costs), and any other liability related to or arising out of your attendance, participation or conduct at the Event.

 

12. Limitation of Liability.

IN NO EVENT WILL (a) AWS BE LIABLE FOR ANY LOSS OF DATA, LOSS OF PROFITS, COST OF COVER OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT, PUNITIVE, EXEMPLARY OR RELIANCE DAMAGES OR (b) THE AGGREGATE LIABILITY OF AWS FOR ALL OTHER DAMAGES IN CONNECITION WITH THE EVENT EXCEED $100.

 

13. Choice of Law and Venue.

These Terms will be deemed made in and will be construed in accordance with and governed by the laws of the State of Washington. For any dispute arising out of these Terms, you irrevocably submit to venue and exclusive personal jurisdiction in the federal and state courts in Seattle, King County, Washington, USA, and waive all objections to jurisdiction and venue of such courts.
