Can financial institutions use AWS?
Yes. Financial institutions in Mexico are permitted to use cloud services, provided that they comply with applicable legal and regulatory requirements, such as those described below.

Who are the financial regulators?
The Comisión Nacional Bancaria y de Valores or “CNBV” (National Banking and Securities Commission) is Mexico's primary financial supervisory authority as it relates to the use of cloud services by banks and other financial institutions. The CNBV inspects, supervises, and surveys financial activities in detail and grants financial institutions their licenses to operate in Mexico.
The Banco de México or “Banxico” (Central Bank of Mexico) issues general regulations and monetary policies. Banxico supervises and regulates the Sistema de Pagos Electrónicos Interbancarios or "SPEI" (Electronic Interbank Payments System), the real-time payments system that banks use in Mexico.
The Comisión Nacional de Seguros y Fianzas or "CNSF" (National Insurance and Security Bonds Commission) supervises the operation of the insurance industry and its solvency and stability.
The Comisión Nacional del Sistema de Ahorro para el Retiro or "CONSAR" (National Commission for Retirement Savings) regulates the Sistema de Ahorro para el Retiro or "SAR" (Retirement Savings System) to verify that pension plans or "AFORES" invest their funds according to parameters and guidance set forth by the CONSAR.

What regulations apply to financial institutions using AWS?
Financial institutions in Mexico may be subject to a number of different legal and regulatory requirements when they use cloud services. The regulations issued by regulators in Mexico provide a framework for financial institutions to use third-party services, which includes cloud services. Relevant regulations include:

Key considerations for financial institutions using AWS
AWS is committed to offering customers a strong compliance framework and advanced tools and security measures that customers can use to evaluate meet, and demonstrate compliance with applicable legal and regulatory requirements.
Financial institutions who are using or planning to use AWS services can review the following consderations to better understand their compliance requirements:
1. Consider the purpose of the workload(s) and the relevant categories of data in order to anticipate which legal and regulatory requirements may apply. For example, the CNBV requires certain entities to keep a copy of operations and accounting records within Mexico. Refer to the AWS whitepaper: Data Backup in Mexico for more information.
2. Assess the materiality or criticality of the relevant workload(s) in light of local requirements. For example, the CNBV requires certain entities to obtain the CNBV's approval before hiring a third-party, such as AWS, to perform operational activities, or database or systems management activities. This authorization may be required for critical and non-critical workloads.
3. Review the AWS Shared Responsibility Model and map AWS responsibilities and customer responsibilities according to each AWS service that will be used. Customers can also use AWS Artifact to access AWS’s audit reports. The AWS compliance programs page helps customers understand the security and compliance controls in place at AWS.

Key data privacy and protection considerations for financial institutions using AWS
Financial institutions in Mexico using AWS services should consider privacy requirements applicable to them such as the Ley Federal de Protección de Datos Personales en Posesión de los Particulares or "LFPDPPP" (Federal Law for the Protection of Personal Data Held by Private Parties), the Lineamientos del Aviso de Privacidad (Privacy Notice Guidelines), or the Ley General de Protección de Datos Personales en Posesión de los Sujetos Obligados or "LGPDPPSO" (General Law for the Protection of Personal Data Held by Public Entities).
In addition, the INAI created a guide with suggested criteria to use when hiring cloud computing services that involve processing of personal information: Criterios mínimos sugeridos para la contratación de servicios de cómputo en la nube que impliquen el tratamiento de datos personales.
AWS customers maintain full control of the content they upload to AWS under their AWS account, and are responsible for configuring access to AWS services and resources. The AWS whitepaper, Using AWS in the Context of Common Privacy and Data Protection Considerations provides useful information to customers using AWS cloud services to store or process personal data.
